Yes and Yes! Probably the most often used rationale, IME, is that the 'best' science wasn't used in the decision and often the appealants don't have any science either nor how to collect in 'best'er...

That is what I was thinking.

Seems like a huge waste of resources and money to get to an answer that is usually pretty cut and dry after the initial research...
