If you think about it, eye witness testimony is used in almost all criminal cases.
Yes, eyewitness testimony is an important factor in most criminal cases. However, those witness' testimony is backed up by physical evidence. I think you would be hard pressed to find a criminal case where a person was convicted solely on a single witness' testimony.

How many criminals would ever be prosecuted if a LEO actually had to catch them in the act of breaking the law? How many murders or bank robberies are witnessed by a LEO? How many poachers are caught in the act?
How many criminals would get prosecuted if all the prosecution had was a single eye witness account? Murderers, bank robbers, poachers, etc. are convicted because of evidence, which includes eye witness testimony.
 
Like I said, if the inforcement officer needs to see the tire track or compare the photos, I'll take them back to the spot. Then they can collect all the evidense they need. I'm afraid that many people don't realize that a lot of gated roads in this area are still open for ATV travel and are still reporting ATVs on these roads as being on closed roads.
