It’s the smart approach - make sure your circuit court arguments don’t trip up a later SCOTUS argument. Done all the time by sophisticated parties.

I hope the cause is getting appellate specialists of note involved. There is a very small club of lawyers that can win at the appellate court and scotus levels.

10% shot absent a circuit split, but one would be a fool not to be prepared at circuit level. Have seen a few winners become losers by B team mucking up circuit arguments.
