I'll look, but that home was well under construction. And as I said, how the heck does it fly under the radar to get that far? I build homes like that. I know the time-line. mtmuley

That is true, but circumstances point to public's complacency and lack of field representatives and enforcement of stream laws until someone hollers.
Are you implying that it's okay to build something in noncomformance as long as you can get it mostly constructed before anyone notices?
No. Absolutely not. But this isn't what happened as far as I can tell. And if it did, where the Hell were the agency's that are tasked with keeping track of it? I know how long it took to get that home to that stage. mtmuley

I agree, but realize there are places in Montana that don't get much attention. (summer cabins, complacent residents, people minding their own business) That is until a white elephant shows up on the very edge of one of the most pristine streams in Montana and someone floats by in July.
FCD doesn't have personnel who are in the field looking for violations. FCD has their hands full with usual 310 permit process and oversight. (bridges, culverts, diversion canals, ponds etal.)

Yes, that is exactly what happened. There are no agencies with oversight regarding inholdings, esp in the national parks apparently. That is essentially what the judge decided; no authority over inholding construction. Obviously the Park Service pays no heed to what happens on those private properties within the park.
Why it took so long for it to be on FCD's radar screen is a good question.

If they followed zoning or the lack of it, they have every right. My question is, how did the materials and equipment get in there? And if it's forestry road, no limitations on what it may be used for?

Ever been to Apgar? It's in Glacier with some private properties, rentals, and tourist stops. No zoning, no rules apparently.

Ill-founded logic on your part, well documented no less, that you lack proper insight along with a penchant for lack of respect for property rights.
Makes me think, judging by what you have typed, that you're the type that's whinier than a Californian.
You should strongly consider looking in the mirror after this defeat, consider what type of person thinks their (yours) feelings are more important than someone's property and you have rights to demolish it.
Based on your feelings. You're wittle, bitty, tiny weeny heart. That's why, that's the foundation of your (and many who posted) argument.
You have provided 0 insight, logically. Youve done nothing but whine about why their stuff should be destroyed. Whine because your feelings are hurt. That's your argument, your whole basis. Feelings.
And, on the insult side, you are ridiculously obtuse. You think with your heart, and not even that intelligently to boot.
But, apgar, the broads who owned the 'famous' corner c-store, fcd, couple others, they have more to come.
You could personally reach out to them individuals and let them know, given you're the doer of good, that their indiscretions will be coming due on payment. That would provide enough entertainment.
Let me reiterate. You should examine what type of person you are, based on what you wanted done to these people, who attempted to do the 'right' thing as is, on their dream home/land. Take a real, good, long look.
Damn though, gloating never gets old when you're right. Now, stop whining, start learning why you were entirely wrong, correct what mislead you to that point, and, probably in 5, 7 maybe 10 years for ya, you can gloat when you're so (unsurprisingly) right amongst a group of clowns.
