Judge orders protections reinstated for gray wolf


HELENA, Mont. (AP) -- A federal judge on Thursday reinstated Endangered Species Act protections for wolves in Montana and Idaho, saying the government made a political decision in removing the protections from just two of the three states where Rocky Mountain wolves roam.

U.S. District Judge Donald Molloy said in his ruling that the entire Rocky Mountain wolf population either must be listed as an endangered species or removed from the list, but the protections for the same population can't be different for each state.

Last year, the U.S. Fish and Wildlife Service turned over wolf management to Montana and Idaho wildlife officials but left federal endangered species protections in place for wolves in Wyoming, where state law is considered hostile to the animals' survival.

"Even if the Service's solution is pragmatic, or even practical, it is at its heart a political solution that does not comply with the ESA," Molloy wrote in his ruling.

Defenders of Wildlife, the Greater Yellowstone Coalition and other wildlife advocates sued the federal government after the Fish and Wildlife Service decision in April 2009. They argued that the government's decision would have set a precedent allowing the government to arbitrarily choose which animals should be protected and where.

The decision puts a halt to wolf hunts in Montana and Idaho planned for this fall. Montana wildlife regulators last month set the wolf-hunt quota at 186, more than doubling last year's number, with the aim of reducing the state's wolf population.

Gray wolves were listed as endangered in 1974, but following a reintroduction program in the mid-1990s, there are now more than 1,700 in the Northern Rockies.

Doug Honnold, an attorney for EarthJustice representing the plaintiffs, said he was gratified by the ruling, though he is sure there will be another chapter to the story.

"For today, we are celebrating that the approach we thought was flatly illegal has been rejected. The troubling consequences for the Endangered Species Act has been averted and the wolf hunts are blocked," Honnold said.
 
Well, it is a sad day for sure when idiocy prevails..............well, I hope every NR that visits MT will take a wolf home with them when they come, dead or alive:)
 
Its not like Wyoming hasnt had ohhhhh, say, 12 years to come up with an acceptable plan...or that Molloy didnt warn Wyoming about a year ago.

I would have ruled the same way, no other way to rule if you're required to follow law.

This is a bummer - without managing these guys, more of our wildlife resources will be consumed - speaking of the wolves & the politicians...

Sometimes it is better to view the larger picture than to immediately go for gold regardless the cost to those you neighbor...

BuzzH is right. I don't think the enviros would have had a prayer in winning this decision if it weren't for Wyoming. Last fall when the hunts were allowed to go forward Molloy kind of tipped his hand and hinted that this was the way the ruling would come down. I think Molloy did the only thing he could do. Now let's hope all three states can come up with an acceptable plan to get the darn things back off the list.

To that effect, something I'm both intersted and worried to see is how Idaho will "manage" the wolf population now. Until now Fish and Game has invested all that time and money into studying and managing the wolf population with the idea that eventually they would get a return on the investment (selling wolf tags). Now that that there won't be any tags sold again in the forseeable future I have it on good authority that Fish and Game may tell US Fish and Wildlife that they won't be much help anymore. Essentially this could mean that Fish and Game would look the other way on "illegal" wolf kills.

Seems like there should be some semantic argument for the definition of population to me. I personally think its a bit of a stretch to call all the wolves in the West one population. Wonder if the USFWS will change that? IMO, they probably realized this was how it would end up, but was a way to thumb their nose a bit at WY. Now there will be even more pressure put on WY by ID and MT to get off duff and put together an approvable plan. The template is already there...
 
I think this will mean the OPPOSITE of them being protected..... more people will be pissed and will SSS... with a legal hunting season... I had settled on NOT SSS'ing....now..... well......
 
I agree with hornseeker, guys are just going to go off now(as if it wasn't being done before, yeah), the only problem with that is loose lips, most can't help bragging about it.

I am not in freak-out mode as of right now, remember, last year, FWP killed more than twice what hunters killed in the hunt, I suspect they will be doing it again. I don't think for a second, game managers will lose the hold on things that was gained last year.

I have even heard rumblings from a guy that is pretty good friends with one of the bios here, he said FWP has some things up their sleeve.

I hope so.

I can't stand the SSS crowd one bit, but I agree with Hornseeker, I think that crowd just got a whole lot bigger. Honestly, I don't think this ruling protected very many wolves at all, if any. It's just a shame that it's probably not going to be done the right way, and that I won't be taking part.

I want my thirty bucks back that I sent to MTSFW...................:D
 
Buzz is right on, Malloy had no choice but to rule the way he did. MT. and ID. have to figure a way to force Wyoming to come up with an acceptable plan so the wolves can be delisted again.

And not only will Wyoming be receiving a friendly "Thank you" card - The SSS crowd will also support the Defenders of Wildlife in a perverse way... A couple media blitzed public examples of illegal killing of wolves will bring the public who think wolves are cute cuddly puppies to their side...

Ego flamed by frustration that dictates limited intelligence. 20 wolves could get wacked - but if just 2 get public attention - it becomes media hyped,
"Endandered species WOLVES being slaughtered in... We need your donations to protect these endangered cuddly puppies..."

Later - Defenders of wildlife and all the other tree huggin ignorant groups will duplicate the thank you card sent to Wyoming to those punks who further make it difficult to enable the states to regulate the wolf numbers...

Any chance anybody has thought, "We will let the sportsmen take care of the problem for us. 'Course we will have to put them in jail for taking out an endangered species to the appease the wolf huggers."
