who writes the hunting regulations?

Who writes the hunting regs, how are they decided on, and how would you go about the process of getting changes made in some? In the state of Montana?
 
In Arizona...we have a "commission" we also have public meetings... Wardens, Managers etc... get input from Hunters/fishermen and also "lawyers".. its complicated trying to please everyone [ groups,etc]...G&Fish does a good job working with Bighorn sheep society... and other like minded groups etc... then sometimes they have to deal with stupid Governors [ Janet Napolatino] who is their Boss...

Go to the Montana public meetings... sign up to speak [ if allowed] ask question etc,etc.
 
Thank you CJ. Just the kind of thing I was wondering. If a person wants to see a change in some area where do they start, and who do they talk to. We do have some open meetings and that very well may be the place to approach it. Looking into it----.
 
Thank you Ben Lamb, the FWP Commisioner is probably the one to go to.
Not trying to change anything major. Just a really painful inconsistency regarding 11-12 year olds being able to buy big game tags, and small game license, but not able to get a trapping license so that they can hunt bobcat.

The new rule, House Bill 221, states that any youth who has completed Hunter Ed. and will reach 12 years of age by Jan 16th, 2011 can participate in "any hunting season" that opens after August 15th this year.
Well that just is not true. Youth fitting the above description can not participate in the Bobcat Hunting season. You must be fully 12 years to buy a trappers license, and a trappers license is required to hunt bobcats. Our boy who fills all of the state requirements to "particpate in any hunting season" was refused a trapping license last week because he won't be 12 until Dec. 4th.
He had no trouble getting tags for deer, elk, bear, lion, and small game but bobcat is a no go.
Hopefully this was just an oversight in the rule change process, but in my own opinion the whole age requirement thing is very close to fitting the very definition of discrimination given to us on page 4 of the deer,elk, antelope reg book. Might not be a bad time to re-visit the reasoning behind the age thing anyway.

Tuesday morning. Just got off the phone with Com. Ron Moody at Lewistown. He wa very helpfull. He is looking into it and seemed to share in my question as to what is up with this.
I will update when he gets back with me.
 
Ron's a good guy. Glad he was able to help. Sounds like an oversight more than anything. Might take a legislative fix if it's defined in statute.

Whoever gave this guy this information was correct. In the last legislature the statute was changed to allow Hunter Ed recipients who will reach age 12 prior to Jan 16 to buy licenses and hunt for game species after August 15, see MCA 87-2-805 (5). Unfortunately, the statute for resident trapping licenses (MCA 87-2-601) was not changed. In order to hunt Bobcats a person needs a trapping license, and you need to be 12 years old at the time of application to apply for that license. The disconnect is in the state statutes, not our regulations. I’m uncertain if that was legislative intent or oversight, but the legislation was specific to hunting. People can legally free-shoot furbearers such as bobcats and wolverines, but they must do so with a trapping license as a prerequisite. Hope this helps, take care. jk

R. Moody did also speak with me on the phone and explained how the process of getting something like this changed works and assured me that he will be looking into it further. Now the bottom line is how to get my kid licensed to hunt bobcats yet this year? I will be looking and asking more questions from more people to see what can be done. To be continued--- twodot
