The jury also cited that the Center did not accurately describe the condition of the grazing allotment

There was not an "activist" judge removing anything in this case. Unless you want to label a jury "activist".

the Jury trial was the libel trial that the rancher won vs. the Center.

The ESA being thrown out was when
A federal district court "ruled the FWS could not obtain 'regulatory jurisdiction' unless the species, in fact, existed. Even if they were on my allotment, the FWS would have to prove that cattle grazing would kill the chub, or the bat.

I can't imagine a Jury trial for a ruling on an Agency regulation/decision.

The rancher won the Libel suit.

The American Public lost when the "activist" court decided that grazing was more important than wild animals on public lands.
 
Good point. I read your comment to mean that a judge awarded the $600,000

I would say there is no proof these species even exist on the allotment. How can that be a loss to the American Public? While it may be the historical range of these species there was no proof that they existed. I just don't see this as a miscarriage of justice. The judge said that in order for the court to find that the FS has 'regulatory jurisdiction' there has be be an endangered species present. I didn't see any where that the judge said cattle grazing was more important then the ESA.

Now tell me how the American Public is being robbed? I am kind of slow to comprehend but what exactly is being lost here?

If a listed species is found and the cows are shown to be a detriment they'll have to be removed or the grazing changed to mitigate the impact. Yes, it does happen. Why do you think so many people are taking a interest in sage grouse? Listing of them would force the closure of many allotments and restrictions on many other activities.

IMO, chubs are a pretty un-inspiring species... ;)
 
I agree that if the endangered species was found there and the cows were a detriment to the said species then by al means reduce or eliminate the allotments.

The issue of sage grouse is going to be interesting. I still wonder why there is a hunting season on them if they are threatened? I stopped shooting them a couple of years ago because a. they suck as table fair and b. they were easy to shoot so no real challenge.

They could be used as a tool to end grazing on alot of territory but that means private deeded land as well as public land will be tied up by this issue.

You went from "apples and oranges" to "chicken and eggs".....

How can the endangered species be found somewhere, if the grazing has already wiped it out on the allottment? The reason the biologists can't find it is because the cows stepped on them all.... Remove the cows, re-introduce the chub and the bat, and the hills will be alive with the sound of music.....
