Irrespective of which tag he used the restriction says the tag is good for any unit in the 300 or 500 except those not opened by the Fish & Game Commission for branched antler elk hunting.
It was the opinion of the judge that these units were opened to branch antler bull hunting, at least as far as his definition overlapped the commissions. By opening a "true spike bull" hunt they were opening a hunt that included some branch antlered bull hunting.
If this all sounds pretty vague and unclear, that's the second reason the complaint was dismissed. The contruction of the regulations were too unclear to bring criminal charges under. So even if you could win on your argument, you would still lose the second reason for the dismissal. Read the decision pages 3-4.
