Dear Friend,

I am writing to inform you that I introduced legislation (S. 339) yesterday to reaffirm each state’s right to regulate hunting and fishing.

This is a Nevada issue, but it also a national issue, as a recent federal circuit court ruling undermines traditional hunting and fishing laws. In Conservation Force v. Dennis Manning, the Ninth Circuit Court of Appeals ruled that state laws that distinguish between state residents and non-residents in allocating hunting tags and licenses are constitutionally suspect. I respect the authority of states to enact laws to protect their legitimate interests in conserving fish and game, as well as providing opportunities for in-state and out-of-state residents to hunt and fish.

In our state, there are great groups such as Nevada Bighorns Unlimited and the Fraternity of Desert Bighorn. These are dedicated sportsmen who spend countless hours and much of their own money building “guzzlers” in the desert, which help provide a reliable source of water for bighorn sheep and other wildlife. These efforts are critical to the protection of Nevada’s rich natural heritage, and I believe that Nevada sportsmen should be able to enjoy the hunting and fishing opportunities that they help make possible through their hard work.

This legislation is very important. The out-of-state hunters who brought the suit in the Ninth Circuit Court of Appeals are now threatening to get a restraining order from federal court to delay the opening of the big game season in Nevada this year. My legislation will help ensure that Nevada sportsmen continue to enjoy the sporting opportunities that our state offers. This issue is of profound importance to Nevada sportsmen, and I am strongly committed to working with my colleagues to pass this bill as quickly as possible.

The purpose of this legislation is to fight the commercialization of hunting and preserve its heritage and traditions . It's that simple , don't burn any more brain trying to figure it out .
 
EG-You been drinkin' again? It is an effort to confirm the state's right to manage hunting and fishing. One state could screw the NR and the next could favor them. So how could you possibly come up with your blanket statement and question? The bill is even sponsored by one of your party leaders.

I see this as good legislation, for as much as can be seen from here right now.. :)
 
Contact him yourself tough guy and see what he has to say.......
I tried to contact Mr. Reid, but apparently he is only responding to Nevadans.

This may be good legislation, but from what was provided, I don't know what is being proposed.
My legislation will help ensure that Nevada sportsmen continue to enjoy the sporting opportunities that our state offers.

Maybe it is a good bill, but from only the "feel good" statements provided, I have no idea exactly what the bill entails. I will have to look into it further.
 
I guess I am not as smart as old AZ402, but I can't see what this bill helps.

A BILL
Relating to State regulation of access to hunting and fishing.


Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. STATE REGULATION OF ACCESS TO HUNTING AND FISHING.

(a) DECLARATION OF POLICY- Congress hereby declares that--

(1) the continued regulation of access to hunting and fishing by the several States is in the public interest; and

(2) silence on the part of Congress shall not be construed to impose any commerce clause barrier to the regulation of such activities by the several States.

(b) STATE REGULATION OF ACCESS TO HUNTING AND FISHING- The licensing of hunting and fishing, or of other access thereto, and every person engaged in hunting or fishing, shall be subject to the laws of the several States which relate to the regulation of such activities.

(c) CONSTRUCTION- No Act of Congress shall be construed to invalidate, impair, or supersede any law enacted by any State for the purpose of regulating the access to hunting and fishing unless such Act specifically so states.

So will the Federal Duck Stamps no longer be required? Will we no longer have to use plugs in our shotguns for waterfowl hunting???

If the goal is to "The purpose of this legislation is to fight the commercialization of hunting and preserve its heritage and traditions . " as you stated. Does that mean that Outfitting and Guiding will be outlawed???

What is more "commercialization" than Outfitting?
 
I question whether this legislation will help as it would overturn a previous court decision. I hope it will. As far as AZ is concerned we could pass legislation to outlaw all commercialization of big game animals but that definitely could put taxidermists and outfitters in a pinch.
 
but i do agree with the legislation....YOU SHOULDNT HAVE A BETTER CHANCE AT GETTING A TROPHY TAG AS AN OUT OF STATER, THEN A RESIDENT !!!
 
Sageghost- I disagree. I don't think they should offer the same amount of tags to non-res as they do residents. But, the chance of drawing a tag is dependent on the number of applicants as well as the number of tags. The following link is to the drawing odd for Utah: Utah Drawing Odds

A quick look will show you that for many tags non-residents have a better chance of drawing than residents. Utah only provides a small % of the tags to non-residents.

we agree there..... i dont think that out of state hunters should have the same amount of tags available to them as resident hunters.i dont agree with bonus points because it discriminates against people who might not have the income... i pay for all the tags for my family every year because it is worth it to me to hunt with family on our land.What happened to luck of the draw... i am assumingthat in an era of MEMEME that there are bleeding hearts in the hunting community...

anybody else signed up to teach hunter safety besides me???

O.K. But at least try not to teach hunter ethics , you are uniquely unqualified , after all children shouldn't be encouraged to hunt from a machine whenever possible should they ?
 
How do bonus points discriminate from anyone? If you can't afford to put in for a bonus point that generally means you can't afford the tag anyway. Also, a few states allow you to buy a bonus point for $5! If you can't afford that then you have larger issues. Plus, the way most systems are set up everyone has at least a chance of drawing, even the first year. Yet, someone who's put in for 10yrs has a better chance. Nothing wrong with that IMO. Putting in for multiple species in multiple states is not that expensive with a bit of planning. Besides, that $5K that was spend on an ATV would allow you to apply for any/all tags that you may want to apply for in the Western US. It's all about priorities.

i disagree with that.....people fall on hard times and they shouldnt have to send in money every year to guarentee a hunt.... people are complaining about the luck of the draw......BONUS POINTS SYSTEM ON THE LOTTERY>>>NEXT ????

how is someone who has been a hunter safety teacher before and nra certified as a firearms safety teacher.......NOT QUALIFIED?? your first mistake is living in nevada!!!!WHAT MAKES YOU QUALIFIED TO TELL ME I AM UNQUALIFIED??? IF YOU CAN AFFORD THEM, RIDE THEM

If you can afford the tags, put in for them.

If people fall on hard times and can't afford to put in for a tag, that should be the least of their worries. Hunting is not a cheap endeavor. If you fall on hard times and you want to put in for tags in 3 states, you may just have to sell that dirt bike or ATV. How many of these 'hard-luck' folks smoke? I'd be most smokers spend more money on cigs than I do on applications every year. It's all about priorities. Look at ID, you can get a tag every year, but that doesn't mean you get to hunt the 'best' units every year. Bonus points systems can also be used to generate a bit more revenue for the F&G. What's wrong with that?
 
of course the IDFG is always looking for ways to make $$$$... i save $ from jan of each year until its time to put in $ for tags..I personally am not worried about money but i do think other hunters are...what bonus points say to me is that if you have money and send it in every year that gives you more of a favored treatment and that i do not agree with..these issues are a very hot topic within the hunting community.

You're full of crap.

Most hunters who apply year in and year out believe they should be rewarded for applying with bonus points.

I think the fumes from the ATV have taken a toll...
