To the extent a state law defined cc as trespass thereby prohibiting access to federal public land it would seem that law could then be legally challenged?
I agree. Paying NR tag fees in ID with a lifetime license and being a legal resident of CO buying resident tags is not violating any law. ID lifetime licenses are issued as non-resident licenses and you pay NR tag fees if you move out of Idaho.
I know this does not set any legal precedent - but in all practicality it seems Carbon County just threw in the towel? And I would imagine it raised the bar on other county prosecutors wanting to take on a case with similar fact patterns.
Also, as many of us mentioned earlier in this thread -...
AMEN! I too am sick and tired of the 'oh they raise critical funds'...I'd add in many cases the value is created by having some highly restricted harvest in at least a few areas to produce trophy animals that bring the $$...so by substantially restricting the average hunters they ensure a...
Thank you for identifying others who've helped...and if there are companies who were a big help I'd like to know all of them too. I literally canceled subscriptions when certain hunter/diy companies stayed silent/neutral on this topic...I'd rather support those who stepped up.
I'm very grateful WY BHA stepped up and these 4 hunters stuck with it. The attention this fight has brought to the issue is a major benefit to public land hunters. Even if legislatures start trying to pass laws making corner crossing illegal - I think that gives folks an opportunity to...
The Eastmans article can't be serious...the state does not owe anyone a tag, especially a NR, and as such they have the right to change allocations or the entire draw system as they see fit. Full stop.
What I do see here, and have mentioned before, is maybe all these...
I think the days of justifying NR tag quotas from a funding/finance perspective are coming to an end. I bet most residents would be plenty happy to pay more for their tags if it meant more tags available exclusively to them (or just less crowding). I don't think we are all that far out from...
Some folks previously cited state legislature responses as a reason not to push this issue. Even if this bill were more clear about explicitly addressing corner-crossing...I say keep the pedal down BHA...vagueness is not the friend of the public land hunter on this issue...and politically it...
Great article, was good to read some of the legal defense positions. Seems they are setting up to force courts to tackle the issue directly. I bet a lot of landowners who prefer some vagueness on this issue are not real happy with this case being brought by the DA.
Disappointing. I get editing out a finishing shot on an immobile animal...but selectively editing out several misses at those ranges gives thousands of viewers a very false sense of how easy, common or likely a shot is at that range. Guessing the only reason they showed the one miss is they had...
Some interesting concepts. I definitely support greater regulation on commercialized/filmed hunts. I dont have a perfect solution but I'd like to see it heavily restrict how many folks can get tags and use them commercially...i.e., for 'content'.
You know these players better than I obviously, just saying if they drop this case how many public land hunters are going to start corner crossing?? If the DA knows they'll lose i suppose they'd rather drop it and hope to keep things as a gray area, but I doubt they expected the public...
I agree, and I think if this case had not received much attention it may have been dropped. I feel like at this point they have to know they have painted themselves into a corner and dropping the case is almost not an option unless they decide they will no longer ticket corner crossing.
For the record, I dont see it as a red vs blue issue either. Public lands access appeals to all political persuasions.
My point was, state legislatures can pass laws and so can the feds...sometimes those governments are controlled by opposing parties which can mitigate the bad ideas centrists...
This brings up a point I've thought of (and raised) before: How much public land, public tag opportunity should be allowed/allocated to commercial activity? Mostly thinking of limited quota tags/applications in western states...
All these social media types are incentivized to produce content...
In the article (and this thread) there is discussion about State's modifying laws to explicitly make corner crossing illegal. I don't share those fears for a variety of reasons, but has anyone evaluated/explored what sort of actions/re-actions would be available to federal landowners/land...
As a donor, I'm good either way. I would not see the prosecutor dropping this case as a bad thing. If they drop this case, I see it as a very big win for public land advocates. It raises the bar significantly on pursuing these cases and will embolden many public land users to access via...
Rinella is awesome. I'm suddenly in the market for some meat eater apparel. One insta post and the guy more than doubles the money raised in like 2 hours...crazy.
My gohunt and onx subscriptions expire soon and I just canceled my renewals. I'm going to be watching to see if either company...
