"Top Colorado officials want the state to set rules that could open thousands of miles of historic trails, cattle routes in national parks, monuments and wilderness areas to roads.
The request, sent to Interior Secretary Gale Norton first by Gov. Bill Owens and later by Natural Resources Director Greg Walcher, is part of a national review of what is and what isn't a road on public lands - even in areas congressionally protected from vehicle use.
Public use - including old horse paths for hauling timber, footways used to dig century-old irrigation canals and wagon trails to forgotten ghost towns - across public lands could be claimed as a right of way by counties and private landowners.
"The law says a right of way is a constructed highway by 1876 standards and that doesn't mean pavement or yellow lines," Walcher said.
