First, a bit of self-promotion. Yes I know there's a small mistake in it, and it'll get fixed on Monday. The Supreme Court hearing was in Bozeman, not Missoula. Not sure how I screwed that up:

Second: This is what we're up against - a billionaire absentee landowner hires a team of lawyers who claim that stream access is unconstitutional and try to misapply another SC decision to influence the outcome. Luckily, the MT Supreme Court is full of sharp folks.
The bad guys, helped out by Montana's own United Property Owners of Montana, have also managed to find an academic who puts his paycheck ahead of the truth: http://www.greatfallstribune.com/apps/pbcs.dll/article?AID=2013305120021
Bruce Farling of Montana Trout Unlimited and Bad-ass attorney extraordinaire Jack Tuholske rebutted this "shallow" oped in fantastic fashion:

The Public Land and Water Access Association has set up a Stream Access Defense Fund in case anyone wants to donate to the cause. Cases like this are time consuming and take a ton of cash.

If you think this doesn't apply to you or your state, remember that with the help of SFW, Utahans lost their stream access through the shennanigans in their legislature. Wyoming resists any attempts to better access to their fisheries, and in fact, SFW lead the charge to ensure that WGFD would end up without critical revenue through tag increases which has led to the defunding of their own small, successful access programs.
This has impacts across the US. Whiskey's for drinking, water's for fighting.
